Terms and Conditions of Use
This Agreement between you and Zain governs your use of ZOOM store and its services (herein referred to as the “Service”),
Zain provides the Service through Zoom, “ZOOM” is an online store that permits you to access, and\or purchase and\or and rent a license for digital Content including mobile applications, videos, audio, images, music files, themes, text, information, data, software and others (“Online Products”).
Only persons aged 18 and above are allowed to create an account on ZOOM, accounts used by persons under 18 shall be registered and monitored by their guardians.
These Terms of Use (“Terms of Use”) govern your use of The Store and the Services provided through it.
Access to [ZOOM] and commencement of steps to create an account (as defined hereunder), constitutes binding and conclusive acceptance and agreement by yourself of all such terms, conditions, and notices contained herein. These Service Terms regulate and govern your access to and use of ZOOM Store and Service, and constitute a binding legal agreement between you and Zain. If at any time you do not accept the Service Terms, you should immediately cease all use and\or Access of ZOOM Store and any other services offered by Zain through ZOOM.
The right to use the Service and\or access ZOOM is personal to you only and is not transferable to any other person or company. Zain has the right to refuse, suspense and or cease the provision of Service to any person\user that refuses to abide by the Service Terms and conditions contained herein, and\ or abuses the rights of use and\or access of ZOOM.
Section 1: CHANGES TO THESE TERMS:
Zain may change these Service Terms at any time. You are responsible for regularly reviewing these Terms and Conditions for any changes. Such modifications, amendments or deletions shall be effective immediately upon posting on The Store. Continuation of use of ZOOM following any such changes will be interpreted as acceptance to such changes by you.
Section 2: USING OUR SERVICES:
You may use the Service in accordance with this Agreement and any applicable laws. You are not allowed to misuse the Service.
You may discontinue your use of the Service at any time.
We are constantly changing and improving the Service. We may add or remove functionalities or features of the Service at any time, and we may suspend or stop a Service altogether. Zain may also in its sole discretion and at any time modify or discontinue providing, temporarily or permanently, The Store or any Materials, Services, or sites, available on or accessible through The Store, or any parts of the foregoing, with or without notice.
The User agrees that Zain will not be liable to the User or any third party for any such modification or termination of The Store or any Materials, Services, or sites, available on or accessible through The Store, or removal or deletion of the Services or any links to other Sites within The Store.
SECTION 3: ACCOUNT, PASSWORD AND SECURITY
As a user you must create an account on The Store website and must verify the account. You are responsible for maintaining the confidentiality of your password, and you are fully responsible for all activities that account take place in your account. You agree to (1) immediately notify us of any unauthorized use of your account or any other breach of security and (2) ensure that You fully exit from your account at the end of each session. We will not be liable (to You or any third party) for any loss or damage arising from or related to the unauthorized use of your account as You will be solely responsible for all activities and actions of your Account. If You violate these terms and condition and\or public order and\or any other laws you may be prevented from accessing the Store or Your account.
Deletion of Account: If You terminate the Agreement or request to close the Account, then Zain shall block your Account and make it unavailable as soon as reasonably practicable.
Resetting your Account: we hold no responsibility regarding any action you make through Your device that might result in resetting your Account on The Store and therefore losing any saved information or any other details (for example by enabling the “clearing your application cash”) on Your device.
SECTION 4: ELIGIBILITY TO USE
By using the Services, you represent and warrant that You are eligible to use the Services as set forth in these Terms and that: (a) all required registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) You are eighteen (18) years of age or older; and (d) your use of the Services does not violate any applicable law or regulation. Your account may be deleted without warning if we believe that you have violated any of the above conditions.
SECTION 5: THE USER RESTRICTIONS ON THE STORE USAGE
As a User, you shall not use The Store in the following manner: To infringe any copyright registered or not registered ,or any other intellectual property right, registerable or un-registrable; to infringe any patent or trademark; To infringe any right of publicity, right of privacy or other proprietary rights of any third party and does not contain any matter which, if published, will be libelous or defamatory; and are not contrary to regional morals, ethics or religion, is not insulting or racist and does not spread hatred against persons or a class of persons.
SECTION 7: LINKING TO OUR SITE:
You may link to our homepage provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.
You must not establish a link to our site in such a way to suggest any form of association, approval or endorsement on our part where none exists.
We reserve the right to withdraw linking permission without notice.

DISCLAIMER: ZAIN MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY OR RESULTS OF THE SERVICES OR INFORMATION CONTAINED ON THE STORE FOR ANY PURPOSE. ALL SUCH SERVICES AND INFORMATION ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED. ZAIN DOES NOT WARRANT THAT THE INFORMATION WILL BE UNINTERRUPTED OR FREE OF ERROR, THAT DEFECTS WILL BE CORRECTED, OR THAT THE WEBSITE OR THE SERVER THAT MAKES IT AVAILABLE, ARE FREE OF VIRUSES OR OTHER ADVERSE COMPONENTS. NEITHER ZAIN NOR THE STORE PROVIDE ANY TYPE OF GUARANTEE OR WARRANT THAT THE CONTENTS ON THE STORE ARE CURRENT, ACCURATE, RELIABLE, COMPLETE OR ERROR FREE. THE CONTENT PROVIDER EXPRESSLY AGREE THAT THE ENTIRE RISK AS TO THE ACCURACY OR COMPLETENESS OF THE CONTENT IS ASSUMED SOLELY BY YOU.
SECTION 9: LIMITATION OF LIABILITY
Under no circumstances shall Zain its officers, directors, shareholders, agents be liable for any direct, indirect, incidental, punitive, special or consequential losses or damages as a result of the using The Store. This includes without limitation, attorneys' fees, whether in an action of contract, negligence or other tortuous action, that result from the use of, or the inability to use, any Services available on The Store, even if Zain has been advised of such damages. Neither Zain nor The Store shall be liable in any manner of any Content uploaded on The Store. As such, Zain shall not be liable for the use or the inability to use The Store or services available thereon. If you are dissatisfied with any Service, information, or with any of the Service Terms, your exclusive and only remedy is to discontinue using The Store.
SECTION 10: THIRD PARTIES AND OTHER USERS
Content from Content Providers and other third parties is made available to you on The Store. Because Zain does not control such content, you understand and agree that Zain is not responsible for any such content, including advertising and information about third party products or services. Because Zain does not have control over such content, Zain makes no guarantees about the accuracy, currency, suitability, or quality of such Content, and Zain assumes no responsibility for unintended, objectionable, inaccurate, misleading, or unlawful Content made available by Content Providers, advertisers, and third parties.
You understand and agree that the availability of links to other websites or locations on The Store is for your convenience and does not signify our endorsement of such other websites or locations or their contents.
SECTION 11: INTELLECTUAL PROPERTY
Copyrights: All copyrights related to any of Zain Materials shall remain at all times the sole property of Zain and shall be protected by the applicable laws and regulations.
You warrant and undertake that the rights of Your Materials belong to yourself, or that you own the necessary rights to use them under these Service Terms, and that no third-party rights of any kind vest in such Materials. As such, you undertake to indemnify and hold Zain harmless from and against all liability, damages, losses, lost profits, claims, demands, judgments, costs and expenses of every nature and kind arising out of or incidental to or in any way resulting from any claims, demands or any other disputes raised by any third party against Zain regarding Your Materials.
Trademarks: you may not use any of Zain's trade names, trademarks, service marks, logos, indicia, designs, domain names, corporate names or other trade dress elements and distinctive brand features, whether registered or not.
SECTION 12: CONFIDENTIAL INFORMATION
Each party acknowledges that it will have access to material, data, systems and other information concerning the operation, business, financial affairs, products, customers, forecasts, plans, calculations, agreements etc. of the other party that may not be accessible or known to the general public, including, but not limited to the Service Terms, the Agreement or disputes between the parties related to the Agreement or the Service Terms, court or arbitration proceedings and all thereto related materials and information ("Confidential Information"). The parties agree that Confidential Information shall remain the sole and exclusive property of the disclosing party ("Disclosing Party"), and the receiving party ("Receiving Party") agrees to maintain (and to ensure that its employees and managers maintain) the Confidential Information in strict confidence and to use the Confidential Information solely for the purposes set forth in the Terms (i.e. the Receiving Party shall not use Confidential Information in any way, except for the purpose of fulfilling the Agreement). The parties further acknowledge and agree that Confidential Information shall be deemed to include all intellectual property rights of the parties. The Receiving Party may disclose the financial terms of the Agreement to its legal and business advisors and to potential investors, so long as such third parties have entered into a confidentiality agreement with the Receiving Party, the obligations of which are at least as stringent as those contained in the Terms. The Receiving Party may disclose Confidential Information if so required by law or competent authority, giving the Disclosing Party prior notice thereof.
SECTION 13: SEVERABILITY
If any term or condition or provision of the Service Terms is determined to be invalid or unenforceable pursuant to applicable law including, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Service Terms shall continue in effect.
SECTION 14: TERM AND TERMINATION
Term and Termination: The Agreement remains effective until terminated. Zain may at any time, without cause, terminate the Agreement with immediate effect.
Consequences of Termination: When the Agreement is terminated, all of the legal rights, obligations and liabilities that the Content Provider and Zain have benefited from, been subject to (or which have accrued over time whilst the Agreement has been in force) or which are expressed or intended to continue indefinitely (e.g. clauses regarding indemnity, limitation of liability, disclaimer of warranties, confidentiality, governing law, disputes etc.), shall be unaffected by the termination.
SECTION 14: ENTIRE AGREEMENT
These Terms constitutes the entire agreement between you and Zain with respect to the Website.
SECTION 15: GOVERNING LAW AND JURISDICTION
These Terms will be governed and construed in accordance with the laws of Amman -Jordan.
All disputes arising out of or relating to the use of the Website shall be exclusively heard by the courts of Amman-Jordan.
No part of these Terms may be copied, duplicated, retransmitted, reposted, in whole or in part, or otherwise used without the express written approval of Zain
